By visiting our website or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

OUR COLLECTION / GALEERY

Our collection of art (sea fans, corals…) is available only through this website. These art have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colours and images of our products that appear at the website.

The colour in our art shown on this website may not represent the colours of the actual corals, sea fans, or any artwork from our website depends on screen calibration, ambient light and many other factors. As Exclusive Ocean  all the original artwork itself  we endeavours to try an achieve as accurate representation as we can.  We reserve the right, but are not obligated, to limit the sales of our Artwork to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any artwork, services, information purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 

PAYMENT AND PRICES 

The Exclusive Ocean accepts all major credit cards. Payments are taken via PayPal, providing a secure gateway for processing transactions. Payments through PayPal can either be made with an existing PayPal account, by registering for PayPal, or by simply entering your card details.Payment can also be made by direct bank transfer. Please note: Any orders placed with this payment method will be put on hold until the funds have cleared successfully. You must pay us the full price for the art agreed delivery by paypal, credit card, bank transfer or such other methods as we agree. “Exclusive Ocean” is not VAT registered so this is not added to, or included in, the prices shown.

EXPORT

If Goods are being ordered from outside the United Kingdom, import duties and taxes may be incurred once your Goods reach their destination. Exclusive Ocean is not responsible for these charges and we undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Art, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Art may be inspected on arrival at port for customs purposes and Exclusive Ocean cannot guarantee that the packaging of your Art will be free of signs of tampering.

You will be responsible for paying any taxes including but not limited to import tax, duty, merchandise, sales or user tax that have to be paid in the country of destination whether on shipment or on import or at any other time.

Unless otherwise agreed in writing, the sale of the Work is not dependent on either us or you obtaining an export licence and failure or delay in obtaining a license will not constitute a basis to cancel a purchase or delay payment for it.

POSTAGE/DELIVERY

Due to the costs and risk of shipping delivery UK orders will be dispatched within 10-15 working days or sooner.
Deliveries outwith U.K. please contact for details. All artwork are sent first class, signed for. A copy of the tracking number will be sent to you as confirmation that the order has been sent. A signature will be required for acceptance of the order. Please advise Exclusive Ocean if this will not be possible. In the event of a non-delivery due to the recipient being unavailable, it is your responsibility to find a suitable alternative for delivery and re-schedule delivery.

I post Monday – Friday except Bank Holidays. I know just how important getting your gorgeous sea fans is and the majority of orders leave me within 48 hours. Please note: all delivery dates are estimates and I cannot be held responsible for delays in deliveries caused by the courier I may use.

In times of high demand shipping may take a little longer. If your parcel has not arrived as soon as you hoped, please allow extra 10 working days for UK orders and 30 working days for International orders before you contact me to allow sufficient time for postal delays to be cleared.

REFUNDS/RETURNS

In the unlikely event that your order should reach you in an unsatisfactory condition, you must contact us info@exclusiveocean.com within 48hrs and return it within 7 days, and in the original packaging. Return postage costs cannot be refunded. 

Refunds will be made to You as soon as possible and in any event within a period of 30 days from return of the Goods.This right extends only to Art returned in the same condition in which they were sold. Artwork must be returned undamaged and in its original packaging.  You will be responsible for the costs of loss or damage when returning the goods, so you should take out enough postal insurance to cover the value – us unless we delivered to you in error.  If we do not receive the artwork back from you, we will not be able to arrange the refund.

In the event that your artwork get damaged in transit, please contact us as soon as possible. We cannot accept responsibility for damaged goods after two working days from the date the order delivery was signed for.

CANCELLATIONS 

In the event that you wish to cancel an order please contact us within 24 hours. 

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

All aspects of this website – logo, images, design, text, graphics, underlying source code and all other aspects – are copyright Exclusive Ocean. In accessing this website you agree that you will only use the downloaded content of the web site for your own personal and domestic, non-commercial reference. No part of this website may be may be copied, reproduced, transmitted, derived in any form or by any means, electronic, mechanical, photocopying or otherwise, without prior permission of the website owner. PURPOSE AND EFFECT

These terms and conditions set out all the terms of agreement other than price between you as buyer and us as seller, in relation to the sale and purchase of the item or items identified in the invoice, which we refer we confirm that we own the Artwork.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
